We have put in place appropriate security measures to prevent personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to personal data to those who have a business need to know.

Purpose of the processing and the lawful basis for the processing

We will process your personal data for the purposes of providing, monitoring and invoicing your non-medical help support.

Our lawful basis for processing personal data is 6 (1) (b) – Contract – and 6 (1) (f) – Legitimate Interests. Processing is necessary for the performance of a contract with you or to take steps to enter into a contract (the provision of non-medical help support to you) and the processing is necessary for our legitimate interests or the legitimate interests of a third party.

Our lawful basis for processing special category personal data is 9 (2) (a) – you have given explicit consent to the processing of those personal data for one or more specified purposes – or 9 (2) (g) – processing is necessary for reasons of substantial public interest.

Categories of personal data

The personal data we will process includes your name, your contact details (address, phone number and email) and any communication preference you have, your funding body name and customer reference number, your ID number, your date of birth, information about your use of our online systems (your IP address, pages accessed, time of page access, browser information), information about your course of apprenticeship, information about your support and any additional information you provide to assist us with matching you to a suitable worker.

The special category personal data we may process is information about your disability, any wellbeing concerns and health-related information related to missed sessions. We always request your explicit consent to process information about your disability and it is only used for specific purposes (i.e. so we can do our best to meet your support needs). If you or your support worker raise any wellbeing concerns and you have provided explicit consent we will share these with your education provider. We are required to provide reasons for missed sessions to your funding body and this may entail processing health-related information if the session was missed due to illness or a reason related to your disability.

Any recipient or categories of recipients of the personal data

We will share some of your personal data with your funding body.

We will share some of your personal data with your education provider.

We will share some of your personal data with the support worker(s) you are matched to.

We may share information about your support usage with your needs assessor/needs assessment centre.

We will share your support records with your education provider if you consent.

We can discuss your support arrangements with a family member or similar thirdparty if you consent.

Details of transfers to third country and safeguards

We will not transfer your data outside the European Economic Area. The servers which store our data are located within the UK.

Retention period or criteria used to determine the retention period

We will retain personal data no longer than is necessary for the purpose it was obtained for, including for the purposes of satisfying any legal, accounting, or reporting requirements. Some personal data will need to be retained for longer than others.

The type of data determines the retention period. For example, we will delete your contact details 1 year from the date your support ceases. Other data, for example invoices for your support, will need to be kept for 6 years from the end of the last company financial year it relates to.

At the end of the retention period the data will be reviewed and deleted.

The deleted data will remain on our data backups for 3 months from the date of deletion. After that time the data will not be held by Clear Links in any format.

The rights available to individuals in respect of the processing

We will process all personal data in line with your rights, which are:

Processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data.

The personal data we will process includes your name, your work contact details (address, phone number and email), information about your use of our online systems (your IP address, pages accessed, time of page access, browser information), the name of the higher education provider, assessment centre or funding body you work for and your job title.

Any recipient or categories of recipients of the personal data

We may share your name and contact details with students/learners that we support.

Details of transfers to third country and safeguards

We will not transfer your data outside the European Economic Area. The servers which store our data are located within the UK.

Retention period or criteria used to determine the retention period

We will retain personal data no longer than is necessary for the purpose it was obtained for, including for the purposes of satisfying any legal, accounting, or reporting requirements. Some personal data will need to be retained for longer than others.

The type of data determines the retention period.

At the end of the retention period the data will be reviewed and deleted.

Purpose of the processing and the lawful basis for the processing

The purpose of processing your personal data is to determine your suitability for work and to contact you regarding this. If you are applying for work in Scotland we are required to carry out a Protecting Vulnerable Groups (PVG) check which will involve processing personal data about criminal convictions or offences.

Our lawful basis for processing personal data is 6 (1) (b) – Contract. Processing is necessary for the performance of a contract with you or to take steps to enter into a contract.

Our lawful basis for processing personal data about criminal convictions or offences is 6 (1) (c) - Legal Obligation - processing is necessary for us to comply with the law. Our processing of personal data about criminal convictions or offences meets the Data Protection Act 2018 Schedule 1, Part 1, Condition 1 ‘Employment, social security and social protection’.

The personal data we will process includes your name, your contact details (address, phone number and email), date of birth, information about your education, qualifications, training and right to work in the UK, your CV, references and professional body membership, date of birth and gender.

We will process personal data about any criminal convictions you may have if you apply for work in Scotland, or at an education provider for a role where a criminal record check is required.

Any recipient or categories of recipients of the personal data

We will share your personal data with Trust ID for the purposes of carrying out right to work checks.

If you are applying for work in Scotland or at an education provider for a role where a criminal record check is required we will share your personal data with Due Diligence Checking for the purposes of carrying out a PVG/DBS check.

We will not transfer your data outside the European Economic Area. The servers which store our data are located within the UK.

Retention period or criteria used to determine the retention period

We will retain personal data no longer than is necessary for the purpose it was obtained for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

If your application is unsuccessful all your personal data will be deleted 6 months from the date the application was unsuccessful.

If your application is successful we will require further personal data from you. You will be provided with a new privacy statement explaining the retention period of the existing and new personal date we have.

The deleted data will remain on our data backups for 3 months from the date of deletion. After that time the data will not be held by Clear Links in any format.

The rights available to individuals in respect of the processing

We will process all personal data in line with your rights, which are:

The special category personal data we may process is information about your disability and health. We always request your explicit consent to process information about your disability and it is only used for specific purposes (i.e. for the purposes of workplace reasonable adjustments). If you are unable to attend assignments due to ill-health we may process this information because we are required by law to process sickness absence data to facilitate the payment of statutory sick pay.

We will share some of your personal data with the student/learners you work with, the education provider and the funding body of the student/learner you work with, Her Majesty’s Revenue and Customs and Nest – the pensions provider we use.

We may share some of your personal data with the Department for Education if we are audited by them.

For example, we will delete your contact details after 1 year from the date your employment ceases. Other information, for example pay details, will need to be kept for 6 years from the date your employment ceases.

The special category personal data we may process includes information on any medical conditions or disabilities you disclose to us. We always request your explicit consent to process information about your disability and it is only used for specific purposes (i.e. for the purposes of workplace reasonable adjustments). If you are unable to attend work due to ill-health we will process this information because we are required by law to process sickness absence data to facilitate the payment of statutory sick pay.
